1. Purpose
These Terms of Service govern access to and use of the kaptto platform, a SaaS service for managing reviews and online reputation, provided by the entity identified in the Contact section. The platform allows you to collect, analyse and manage customer reviews, generate feedback campaigns and monitor satisfaction metrics.
2. Acceptance
By creating an account or using the platform, the user declares that they have read, understood and fully accepted these Terms. If you do not agree with any provision, you should refrain from using the service. Continued use of the platform after any changes to the Terms constitutes tacit acceptance thereof.
3. Account and Access
Access to the platform requires creating an account with valid credentials. The user is responsible for maintaining the confidentiality of their access credentials and for all activities carried out on their account. Each account is personal and non-transferable. The contracting company may create accounts for its employees, assigning them different access levels (administrator, business manager, local manager, member).
4. Use of Service
The user undertakes to use the platform lawfully and in accordance with applicable legislation. It is expressly prohibited to: (a) use the platform for fraudulent or illegal purposes; (b) manipulate or fabricate reviews; (c) attempt to access third-party data without authorisation; (d) intentionally overload the service infrastructure; (e) reproduce, modify or distribute the software without prior authorisation.
5. Data and Privacy
The processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR) and other applicable legislation. The user guarantees that they have obtained the necessary consent from their customers for the collection of reviews and contact data through the platform.
6. Intellectual Property
All intellectual property rights relating to the platform, including software, design, logos, trademarks and content produced by kaptto, are the exclusive property of the responsible entity. The user retains ownership of the data they enter into the platform, granting kaptto a limited licence to process such data for the purpose of providing the service.
7. Limitation of Liability
kaptto will make its best efforts to ensure the availability and correct functioning of the platform, without however guaranteeing a service free from interruptions or errors. kaptto shall not be liable for: (a) indirect, incidental or consequential damages; (b) data loss resulting from factors beyond its control; (c) improper use of the platform by the user; (d) content of reviews submitted by third parties.
8. Changes to Terms
kaptto reserves the right to modify these Terms at any time. Changes will be communicated to users with a minimum of 30 days' notice, by email or notification on the platform. Continued use of the service after the changes take effect constitutes acceptance thereof.
9. Applicable Law
These Terms are governed by Portuguese law. For the resolution of any disputes arising from the interpretation or execution of these Terms, the courts of Lisbon shall have jurisdiction, with express waiver of any other.
